Project Terms and Conditions

Contracting us for work you agree to the terms set below.

:The Work
1. Projects are commenced in the order in which they are
received.
2. If you have an urgent deadline that needs to be met, be
sure to inform us before project commencement so we can
determine whether this will coincide with our schedule.
3. Project schedule is estimated depending on the size of
the project. Project completion greatly depends on SWIFT and
Clear Communication by both parties.
4. Please note, you MUST have your hosting setup Prior to
project commencement. We Require that you furnish us with a
temporary password and login information for your hosting
(if you do not have hosting, you can sign up for hosting for
only $11.95 a month with
http://www.eiphost.com ) We will not take projects that
require 3rd party uploads. This just complicates matters for
both parties.

Payment
1. Payment is required upfront to commence your
project.
2. If a custom Logo is part of your project, it
will be billed separately (not included as part of a deposit
based project) as it can be utilized independently from the
project.
3. We will not commence work on your project until full payment has been received.
4. The payment is non-refundable once work on
your project has commenced.
5. Payment is expected in full within 2 days of project
completion, regardless of when you plan to implement the
product.
6. Payments must be made by either credit card, Google
Checkout
or PAYPAL.
Support
1. We provide 2 weeks of support after your store launch to
assist you in the initial store and template setup. We will
not make any major design or coding changes during this time
- these will have been approved and finalized for you prior
to project completion.
2. Any support required beyond agreed support period may
incur additional support fees.
Designs &
Revisions
Our process has 3 stages - Initial Concept, Design Process,
and Setup.
1. After payment has been made, We will send you a Proof of
the Design concept within 72 Business hours, with an
initial design concept outlining the proposed overall design
direction and plan. This is based upon your preferences and
the information you have submitted with your order. If you
wish to try other design concepts or compare different
ideas, we will provide a maximum of 3 design concepts.
Additional concepts will incur additional fees.
2. Once a design concept has been chosen and approved by
you, we will provide more detailed proofs of the design and
allow for you to make revisions to best suit your
specifications. The number of revisions made will be limited
to what we consider reasonable. Revisions do not
include revisions to the Initial Design Concept - revisiting
this stage would incur the appropriate additional charges.
Any work above and beyond what has already been approved
will be billed at a rate of $50 per hour.
Stock
Photography & Images and Music Loops
1. Up to 3 stock photography images from fotolia.com are
included in your purchase price. If you require more images
there will be additional fees.
2. We retain the right to use any stock photography images
we have purchased in future projects if you choose not to
use them in your own project.
3. You may supply us with your own stock photography you
wish for us to use. They remain your property. It is your
responsibility to ensure the correct license has been
purchased for the images, and that you are not infringing
copyright in their use.
4. If you would like to use a Music loop in your project,
they can be purchased from
www.opuzz.com. Loops range from 4.99-9.99. This is
optional and not included in the package price. If you want
to use your own music on a designed page, you must submit it
to us in .wav format and must be maximum 30 seconds long so
it does not violate any copyrights of the owner. You are
responsible for editing the music, ie, fade in, fade out,
timing, etc.
Disclaimer
* We reserve the right to refuse or terminate any order.
* We retain the copyright of all files and coding until
final payment has been received in full. Designs and coding
may not be used in any way (whole or in part), nor can they
be used as the basis for other designs, until final payment
has been received.
* It is the clients responsibility to ensure the images and
content provided to us, or the design concept requested of
us, does not breach copyright or the intellectual property
of another party. We will not be held responsible for any
copyright issues arising out of use of any images or content
in your designs, or design concept.
* We will not be held responsible for loss of data after
product delivery. Please keep a backup of the HTML code and
images we provide to you on project completion.
* If you require us to install your store or template for
you, you will need to provide your username and a temporary
password to us in order to access your eBay or auction
management account. Giving this information out (even a
temporary password) is a risk. While we take every care to
ensure this information is kept confidential, we cannot be
held responsible for anything that happens as a result of
you providing this information to us through an insecure
form (via email). It is your responsibility to ensure your
password is changed promptly once we have finished updating
your account.
